This document (hereinafter referred to as the "Policy") describes how Elite Digital Services, LLC, the owner and operator of the Fakturuj.si service (hereinafter referred to as the "Provider" or "we"), processes and protects your personal data when using our online invoicing service in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data (GDPR). For the purposes of GDPR in the EU, the Provider's representative is Euro business company Kft., with its registered office at Rómer Flóris utca 8/B. 3.em., 1024 Budapest, Hungary.

This document informs you about what personal data we collect, for what purposes, on what legal basis, to whom we may provide it, how long we retain it, and what rights you have in relation to the processing of your personal data.

Elite Digital Services, LLC is responsible for the processing of your personal data. For the purposes of EU GDPR compliance, the controller's representative in the EU is Euro business company Kft.

Distinction of Roles

In relation to the personal data of Users (registration data, payment data, service usage data), Elite Digital Services, LLC acts as the Controller within the meaning of Article 4(7) of the GDPR.

In relation to the personal data of Users' clients (data on invoices, client contact details), Elite Digital Services, LLC acts as a Processor within the meaning of Article 28 of the GDPR. The Controller of such data is the User themselves.

2. What Data We Collect

When using our Fakturuj.si service, we may collect and process the following categories of personal data:

  • Registration data: first name, last name, e-mail address, password (in encrypted form)
  • Billing data: address, Company ID, Tax ID, VAT ID, bank details
  • Client data: names, contact details and billing information of your clients
  • Payment data: information about your payments for the service
  • Usage data: information about your interaction with our service

3. Purposes of Personal Data Processing

We process your personal data for the following purposes:

  • Providing and managing our invoicing service
  • Processing payments for the service
  • Communicating with you regarding our service
  • Improving and personalizing the service
  • Fulfilling legal obligations
  • Protecting our rights and interests

4. Legal Basis for Processing

We process personal data on the following legal bases:

  • Performance of a contract: processing is necessary for the performance of the service agreement
  • Legitimate interest: we have a legitimate interest in improving and securing our service
  • Legal obligation: processing is necessary for the fulfilment of legal obligations
  • Consent: in some cases, we may process your data based on your consent

5. Data Retention Period

We retain your personal data only for the necessary period:

  • Data required for accounting and tax purposes is retained for the period required by law (typically 10 years)
  • Data required for the provision of the service is retained for the duration of your account
  • After account cancellation, we retain only data that is necessary to fulfil our legal obligations or to protect our rights

6. Recipients of Personal Data

We may share your personal data, where necessary, with:

  • Providers of technical and support services
  • Payment service providers
  • Elite Digital Services, LLC (owner and operator of the Fakturuj.si platform), which processes data as the Provider of the service, not as a third party

7. Transfer of Personal Data to Third Countries

In connection with the processing of payments for the Service, your personal data may be transferred to the United States of America (USA), where Elite Digital Services, LLC (owner and operator of the Fakturuj.si platform) is based.

The transfer of personal data to the USA is carried out in accordance with Articles 44 to 49 of Regulation (EU) 2016/679 (GDPR), based on:

  • the EU-US Data Privacy Framework (DPF), if the data recipient is certified under this programme; or
  • Standard Contractual Clauses approved by the European Commission pursuant to Article 46(2)(c) of the GDPR.

The scope of transferred data is limited to data strictly necessary for payment processing (billing data, business identification data). Personal data of your clients is not subject to this transfer.

8. Data Security

We have implemented appropriate technical and organisational measures to protect your personal data against unauthorised access, loss or damage.

These measures are regularly reviewed and updated.

The Service is operated through third-party cloud infrastructure . The Provider does not own its own data centres. Data is protected by encryption in transit (TLS 1.2+) and at rest, access controls (RBAC), multi-factor authentication, and regular backups.

In relation to the processing of your personal data, you have the following rights:

  • Right of access to data
  • Right to rectification of data
  • Right to erasure of data (right to be forgotten)
  • Right to restriction of processing
  • Right to data portability
  • Right to object to processing

12. Changes to the Privacy Policy

We may update this Privacy Policy from time to time. The current version will always be available on our website.

13. Limitation of Liability

The Provider makes reasonable efforts to protect your personal data; however, to the maximum extent permitted by applicable law, the Provider excludes liability for any losses, damages, or unauthorised access to personal data caused by events beyond its reasonable control, including cyber attacks, hacking incidents, technical failures, server outages, actions of third parties, or force majeure.

The User acknowledges that no system of data transmission over the Internet or method of electronic storage is 100% secure, and the Provider cannot guarantee absolute security.

14. Governing Law

This Privacy Policy is governed by the laws of the State of Delaware, USA, and constitutes an integral part of the General Terms and Conditions. In matters of personal data protection, the mandatory provisions of Regulation (EU) 2016/679 (GDPR) shall apply exclusively to the extent that they are directly applicable.
